Restoring Driving Privileges after a Suspended License

 Posted on December 00, 0000 in Driver's License Suspension

Illinois defense attorney, Illinois criminal lawyer, Illinois DUI attorney,For many Muslims in DuPage County, having a driver’s license is necessary to get to work in the area, to conduct business on a daily basis, and to provide for the needs of your family. As we have discussed previously, your driver’s license can be suspended for a number of different reasons under Illinois law, including but not limited to:

  • DUI conviction;
  • Violation of a Graduated Driver Licensing (GDL) program;
  • Failure to appear in court;
  • Excessive points for other traffic violations;
  • Unpaid parking tickets; and
  • Failure to pay child support.

If you are facing a license suspension, we know that one of the most important things is doing all that you can to have your driving privileges restored. There are different ways in which you may be able to have your license restored, and you should do everything you can to abide by the terms of the driver’s license suspension until your driving rights are restored. At the Farooqi & Husain Law Office, we understand that facing a driver’s license suspension can be frustrating and extremely concerning if you rely on your car as your sole mode of transportation. We can examine the facts of your case and can discuss your options with you today.

Hearing to Have Your Driver’s License Reinstated

One of the first steps you will need to consider in having your driving privileges restored is to apply for a hearing. Depending on the reason for which your driver’s license was suspended, you will need to request either an informal hearing or a formal hearing. If you are able to have your driving privileges reinstated following a driver’s license suspension, you will need to pay reinstatement fees. According to cyberdriveillinois.com, the website for the Illinois Secretary of State, drivers with suspended Illinois licenses should understand the distinctions between these types of hearings:

  • Informal hearings are required for Illinois drivers who have had their driving privileges revoked and their licenses suspended for reasons that do not involve a fatal accident. Informal hearings typically are for drivers whose licenses have been suspended due to a single DUI disposition or “sanctions related to lesser moving violations.” These informal hearings are conducted by a hearing officer, and they are held regularly each week. The outcome of a hearing either can be a full reinstatement of driving privileges or the granting of a Restricted Driving Permit (which generally happens when someone has DUI convictions or other serious sanctions on their records).
  • Formal hearings, as the title might suggest, are more serious than informal hearings and are “required for a driver whose privileges have been suspended or revoked for an offense(s) involving a fatality or multiple DUI dispositions.” Formal hearings must be requested in writing, and they require a non-refundable $50 filing fee, as well as other substantive information.

If you are eligible to have your license reinstated following a suspension, you will need to pay reinstatement fees. Depending on the reason for your driver’s license suspension, the fee varies. In general, for license suspensions related to lesser moving violations and other first offenses, the fee typically is $70. However, you should discuss your specific case with an experienced lawyer before you seek a hearing and prior to paying required reinstatement fees.
